Conditions of sale

1) Subject

The contracts of sale of products, entered remotely via computer network at "www.marcoripa.it" shall be governed solely by these general conditions of contract.

2) Parts

These general conditions of contract shall exclusively govern sales contracts concluded by user and Marco Ripa, with registered office in Via Galileo Galilei n 20, Porto San Giorgio, Fermo 63822, Italy PI 02085680441. Without considering the effect of purchase order made by anyone who is not a resident or domiciled in one of been enabled or who shall not have attained the age of eighteen.

3) Conclusion of the contract and acceptance of general conditions of contract

The contracts of sale of products on the site Marco Ripa www.marcoripa.it are considered concluded at the time that comes to Marco Ripa the purchase order made by the consumer.
Contracts for the sale of products are finalized when received on the site Marco Ripa www.marcoripa.it.
Marco Ripa promptly send the consumer received a purchase order made by the consumer.
The consumer, by sending electronic of the purchase order, declares to have read and to have accepted these terms and conditions of contract and undertakes to observe and respect in its dealings with Marco Ripa.
Marco Ripa will promtly send the consumer verification that the purchase order has been received. The consumer, by sending an electronic copy of the purchase order, declares that they have read and accepted the terms and conditions of the contract with Marco Ripa.

4) Obligations of the consumer

The consumer is required, before sending the purchase order, to read carefully the general conditions of contract. Forwarding of the purchase order involves their full knowledge and acceptance of the terms.
The consumer must, finally, once the purchase process online, print and keep these general conditions of contract, already examined and accepted during the conclusion of the contract. Once the purchase process is received online, the consumer must print and keep the general conditions of the contract which have already been examined and accepted.

5) How to purchase

The consumer will buy the product, whose characteristics are described online on their respective pages at the price specified therein to which are added the costs of delivery specified on the site.
Prior to the order, the consumer is shown the unit cost of each product chosen, the total cost of the order and the delivery costs.
After submitting the purchase order, the consumer will receive from Marco Ripa an email message stating confirmation of receipt of the purchase order, the information on the main characteristics of the goods purchased, the total cost of the order, the delivery costs, applicable taxes, means of payment, and containing a reference to the general conditions of the contract and information about the existence of the right of withdrawal, the conditions and manner of its exercise displayed on the site. "Following the approval of the Decree Law July 4, 2006 n. 223 "budget measure" Art. 37 paragraphs 8 and 9, converted into Law 248 of 4 August 2006, entered into force on 12 August 2006 is restored to the obligation of realization of the list customers and suppliers, "and so this implies the necessity of requiring customers that required invoice (instead of the simple receipt) to include VAT and TAX CODE in the appropriate fields on the site.

6) Payment

The consumer may make payment by choosing one of the following methods listed

a) Payment by credit card
Payment for purchases by credit card can only be made with the following credit cards: VISA, MASTERCARD, and only by the owner / holder of the credit card. 
The verification of the correctness of payment data communicated by the consumer is the sole responsibility of the Institutes of the credit card issuers.  
In the event that the consumer wishes to pay by credit card, it may use a procedure make available / provided by Paypal, suitable to ensure the confidentiality of the data provided by customers. In particular, this procedure involves the insertion of the data of the credit card via Secure Socket Layer and communication between the bank and shop via Secure Channel. 

  1. b) Payment by bank transfer.
    Payment by bank transfer can be carried out using the following procedures:
    - Banca: UBI BANCA
    - IBAN: IT 29 Z 03111 69660 000000005589, payable to Marco Ripa
    In case the payment is made by bank transfer, the item purchased will be shipped to the address specified by the customer upon receipt from the bank, on average, five days after completion of the transfer.
    To expedite processing time, after the bank transfer has been made, send the identification number SEPA (CRO) combined with your order number by email to info@marcoripa.it.

7) Delivery of products

The purchase, together with the receipt / invoice, is delivered to the consumer by courier to the address indicated by the consumer.

The payment may be made in advance by bank transfer or credit card according to the instructions contained in art. 6, letter b) of this contract, and Marco Ripa is required to send the goods at the time of receiving the confirmation of the transaction.
In the case of non-delivery due to the absence of the recipient at the address indicated in the order, the courier will leave a notice and try again a second time; if the recipient proves to be still absent, the goods will be returned to sender (Marco Ripa).

8) Ensuring compliance and defective products

The products purchased on the site "www.marcoripa.it" are subject to discipline on the sale of consumer goods contained in Articles. 1519 a - 1519 h of the Italian Civil Code.
The delivered products must comply with the features shown on line in their respective pages and techniques.
Marco Ripa is liable to the consumer for any lack of conformity existing at the time of delivery. If in any case the goods delivered lack conformity, the consumer has the right to restore conformity of the goods.
Without prejudice to the enforceability of the remaining provisions contained in articles. Ter and 1519 of the Italian Civil Code, the above right is recognized in the consumer provided the goods supplied have been used correctly, respecting its destination and as provided in the instructions for use which accompany the product purchased. In particular, the above guarantee does not apply to goods that have defects that the consumer knew about at the time of conclusion of the contract or could not ignore the use of ordinary diligence.

a) Terms

The consumer is required to report to Marco Ripa the lack of conformity of the goods within 10 days from the date on which the defect was discovered. The consumer loses the rights listed above if not denounced for the lack of conformity within the period stated.

9) Right of withdrawal

The consumer has the right to exercise the right of withdrawal. In particular, the consumer has the right to terminate any contract with Marci Ripa, without penalty and without specifying the reason. The consumer can exercise the right of withdrawal within fourteen (14) business days following the date of delivery of the product in accordance with the provisions of Articles. 64 and following of Legislative Decree no. 206/2005 (the Consumer Code)

The withdrawal right is recognized in relation to any property which was purchased on site "www.marcoripa.it" except, for example, products that require activation / start made by the consumer after delivery:

a) Procedures for the exercise of the right of withdrawal
The right of withdrawal is exercised by sending, within that period, a written notice to the email info@marcoripa.it explaining the reasons for the return and the order reference.
The withdrawal notice may also be sent, within the same period.
In case of exercising the right of withdrawal, the communication must be made by sending a request to the email info@marcoripa.it.

If goods have been delivered, the consumer is required to return them to Marco Ripa within ten working days from the date of delivery of the goods.
Good should be returned to Marco Ripa complete with all accessories, instruction manuals and all that was originally delivered to the consumer and packaged in its original wrapping. The product should be returned together with a copy of the electronic receipt of the order and any other receipt.
The costs of returning the goods to Marco Ripa are borne by the consumer.
If the right of withdrawal is exercised by the consumer pursuant to the provisions of this clause, Marco Ripa is obliged to reimburse the sum paid by the consumer.
In particular, Marco Ripa will refund the cost of goods dispatched inclusive of shipping charges within thirty days from the date on which it became aware of the right of withdrawal by the consumer. This operation is performed by the bank issuing the credit card used for payment or crediting the sum to the bank account indicated by the consumer.
Marco Ripa has the right to reject any product returned with conditions other than those specified above, as well as products for which the cost of returning has not been fully paid by the consumer, or have not observed the procedures and timeline for communication exercising the right of withdrawal.

10) Termination clause

In case of failure to pay all or part of the purchase price of the property, Marco Ripa reserves the right to declare pursuant to art. 1456 of the Italian Civil Code resolved this contract by sending a written communication to the electronic consumer.

11) Applicable law and jurisdiction

This agreement is governed by Italian law. Any dispute concerning the conclusion, interpretation, performance or termination of this contract, shall be referred to the exclusive jurisdiction of the courts of the place of residence or domicile of the consumer,if located within the state.

12) Referral

Although not expressly provided in this agreement, the rules of Italian law apply.
